Special Moments Studio (“The Company”) of Kingsway, Derby, DE22 3BN hereby undertakes the positions of photographer/videographer at the wedding of those named hereafter referred to at “The Client”

The Venue

The client accepts that venues to be used may restrict or prohibit the filming of all or certain events. It is the clients’s responsibility to obtain the necessary permissions. Any fees relating to filming taking place at the wedding venue shall be solely the responsibility of the client. You must advise us immediately if there is any change of venue. This must be within 72 hours of the event or in writing otherwise.

Special Requests

We will make every endeavour to accommodate special requests but cannot guarantee to do so and we accept no liability to you in respect thereof.

Payment

A non-refundable deposit of £100 is required at the time of booking. The balance being due 14 days before the event by cheque or cash.

Expenses

You undertake to pay mileage expenses at an agreed rate if the return journey exceeds 20 miles from Derby. You also undertake to provide reasonable sustenance at appropriate times of the day. This will usually be for 2/3 persons but will be subject to negotiation if more crew are involved.

Copyright

The film, music, graphic artwork and other media remain the copyright of the videographer. If you wish to provide us with materials for inclusion in your video/DVD then by doing so you warrant that you hold the rights to that material and indemnify us against any claim for breach of copyright. You must obtain written permission from any outside photographer to use photographs and own any CD containing the music to be used.

Cancellation by You

If you cancel you must do so in writing. Cancellations will incur a penalty as follows: Time of booking to 15th day prior to wedding: Deposit and 25% of total price, From the 14th to 7th day prior to wedding: Deposit and 50% of total price, After the 7th day prior to wedding: Deposit and full total price.

Changes to your booking by Us

We will not normally make any changes to your booking, but if due to circumstances beyond our control we find we have to make a change then we will negotiate it with you and agree the changes in writing. If we are unable to attend your event for any reason, for example illness, then we will endeavour to provide an alternative photographer/videographer but cannot guarantee to do so. Our liability to you is limited to refunding any monies paid. It is in your best interests to ensure you have adequate insurance cover for such an eventuality. The company reserves the rights to cancel this contract immediately without penalty if in its opinion it is being asked to participate in an activity that would bring its good name into disrepute whether legally or morally.

Artistic Licence and Coverage

The photographer/videographer shall be granted complete artistic licence in relation to poses captured and locations used. The photographers/videographers judgement regarding locations and number of photographs/scenes filmed shall be final. Due to the vagaries of the weather, unforeseen restrictions and the willingness of subjects it may not be possible to capture all photographs or scenes requested. You undertake at all times to fully co-operate with the photographer/videographer and give all reasonable assistance and access sufficient to allow the company to fulfil its obligation under the terms of this agreement.

Limitation and Mechanics

DVDs shall be supplied to clients in UK PAL format and 4x3 picture aspect ratio. Camera/Video equipment cannot provide an exact colour match and sometimes it will be impossible to capture an exact colour as seen by the human eye. Certain objects and clothing may give rise to anomalous Moiré é patterns. In poor or reduced lighting conditions video cameras automatically attempt to compensate and this may result in reduced quality and ‘graininess’ in the image. The Company cannot be held responsible for incompatible DVD playing equipment not being able to play the DVD+R format.

Limitation of Liability

In the unlikely event of total camera or video camera failure the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for any indirect or consequential loss.

Force Majeure or Act of God

The company shall not be liable for any default due to circumstances beyond their reasonable control, including Acts of God, war, civil unrest, riot, strike, fire, flood or earthquake.

Delivery

The final version will normally be delivered within 2 to 4 weeks after the event being recorded. The company does not guarantee a delivery date and in some circumstances, for example during busy periods, holidays or Christmas, a longer time may elapse before delivery.

Rights of Consumer

Nothing in these terms and conditions shall affect the rights of you as a consumer.
